You don't even have to give citizens the Miranda warning before being arrested for a crime. Miranda is only required before a "custodial interrogation." It is common practice for cops to give the warning following arrest to assure that inadvertent statements made by the arrestee are not thrown out (e.g. a defense attorney arguing that the cops were "interrogating" the suspect in the back of the car). The Supreme Court has held that Miranda is a constitutional requirement. The Supreme Court has also held that the Constitution protects non-citizens while in America (note: this is why we are holding "enemy combatants" in Guantanamo Bay). However, there are a bunch of exceptions to Miranda. So without more specific facts, I understand why an attorney has not given you a a direct answer. Miranda does apply to illegal immigrants, but so do all of the exceptions. Moreover, Miranda is never a requirement of arrest (whether you are a citizen or not).
