What age people get driving licenses or can get married. This differs from state to state, because regulation of people's lives in this fashion was not given to the federal government in the Constitution, nor has it ever been added to the Constitution by amendment. Originally there were no laws governing these things at all, so it devolved upon individuals to decide. However, as time went on and problems happened, although the federal government did not have the right to write laws regarding these, according to the 10th Amendment the state governments could take over from individuals and impose regulation, and they did.
Even drinking age is actually set by the state. There is now a "national" drinking age simply because the federal government, which DOES control moneys allocated to the maintenance of interstate highways, told the states that if they didn't raise it to 21 that the government would cut their available highway money.
