  • Laws vary by state, but generally, yes. Of course, if a locksmith opens a lock without verifying ownership, he could be liable under tort law for an harm that results. As for criminal law, the locksmith would need to have knowledge that the customer was not the owner, or would have to act in reckless disregard, in order to have committed a crime.
