  • There are much-needed questions to be asked, before a logical answer to your question can be given. 1. was the person, in the auto, related to your manager? 2. does your employment give you absolute off-duty status or are you subject to being on call? 3. did your manager or someone else, discover your sex incident? 4. have you been warned against this behavior in the past, and ignored it? 5. did your have a work ageement, that was violated? tough to answer this question with so many variables involved and unknown. but, in generality, ones off-duty personal life should have no bearing on an individuals employment or promotion. but, i must add, some occupations come with strict code of ethics on and off-duty. there is a line between punishment, for an offense, and personal opinion that hinders a promotion. a discrimination case might be made, IF ALL THE ABOVE DOES NOT APPLY TO YOUR QUESTION.

Absolute Off-Duty Status. 3. did your manager or someone else, discover your sex incident? The manager discovered it as he drove by. It was an area under a car port off company property. The exit area from company property happens to go past the car port, which is 1/2 mile off company property. 4. have you been warned against this behavior in the past, and ignored it? Yes. The employee and I work together. We have kindled a relationship. But during On-Duty we keep things separate. We each have a job to do like anyone else. We see each other after hours, and stopped at the car port for some after hours, off-duty activity. 5. did your have a work ageement, that was violated? No work agreement. However, if I had made the promotion I would have been her superior. She would have been under me. I was told that because I was seen having sex with her in my car under the car port, I could not be promoted because my Off-Duty lovemaking would have been ethically unbalanced for the promotion of being her superior.
