That happened to me and although I didn't press charges, I felt violated.. I was molested. Legally, it is illegal, morally, it is unacceptable.

In the U.S., it depends on how the state defines rape in their criminal code. A broad definition defines rape as "sexual penetration without consent, including both psychological coercion and physical force of the vagina, anus and mouth by any object, finger or penis. Both males and females can be raped and perpetrate rape." The above definition is valid in some U.S. states. But many U.S. states indicate "rape" must be penetration of the vagina and others state it must be penetration by the penis. Even where it is not defined as "rape", it is sexual assault and/or sexual battery and it IS a crime.

Yes, it is by legal definition in my state. No means no, regardless of what penetrates the victim. Would it have been any less rape if the perp had used an object? No. It's still rape.

Most statutes require penetration. Depends how the fingering occurred (surface vs insertion)Question is did you say no! I'm thinking, if you let him get that far you would have a tough time claiming rape. Most rapists leave out the foreplay. Sorry to be so blunt.

Rape is when you say no and he carries on, you have the right to say no! but do not put another in conflict when you dont like it or later regret it,it is only rape if you were not at allowance at this time,you had the chance to withdraw or were you forced,if so then please speak to your parents and the School advisors.

It would be difficult to prove in a court or law. Nevertheless, you should file a complaint with the police so that the perp will have a history that the court system can work with. I doubt it's the perps first, or last time doing it. Stay safe, Axe.

It is sexual assault....and it doesn't matter if you can win a case or not. You can still report this and charge him. You don't know if there are other charges on hold due to lack of evidence. The police may have a file on him and can get all the other victims together as witnesses for the prosecution. This kind of behaviour should never be glossed over as insignificant.

If you say no to any sexual contact and the person still does it then that is rape. Being fingered is not a peck on your cheek. They had their fingers inside someone who did not want to be fingered. It is rape.

Its more likely to be called sexual assault...its still wrong and illegal if you didnt want it to happen.
