  • Absolutely NO. It's not like paying rent. You cannot place HOA dues into escrow in order to get them to perform their duties. The HOA will merely place a LIS PENDING on your property and if you don't pay then Forclose on you. You can however write a letter describing the problem and quote your Declarations that show the HOA's respponsibility to maintain landscape, common grounds, etc. and have it signed by all your neighbors. Send it to your HOA certified mail with return receipt. Then if they don't fix the lawn you have grounds to sue them in Small Claims Court for the repairs plus cost of your filing the suit.
  • HOA's are bullshit for the most part, I'd put my grass seed out. What will they do, make you pick up the seeds, file a written complaint? HOA's are usually like the United Nations, they talk a lot and have no balls or power to do much about anything unless it is criminal activity. They cannot arest you for putting grass seed out.
