  • Everyone should get a tax break or a medal, for stopping a growing parasite from becoming a squirming crying monster baby! Man I hate babies. The only thing worse than a baby's crying is a baby laughing... it mean it's happy, and that can only mean no good. At least when it's crying, it might be suffering, starving, or dying. And that's something worth being happy about!!! Okay, forgetting about hating babies for a minute... the man should only be charged with killing the wife, not the unborn baby. I'm pretty sure no state charges a man for killing an unborn baby; that's ridiculous, if you allow abortion. If somehow it has been illegalized in some states, but abortion not, well, my opinions on this are that it's damn screwed up, and that it shouldn't count as two murders to kill a pregnant woman. DUH!
  • I think anyone that performs an abortion, along with the willing mother, should be charged with murder. As well as someone that kills the mother and the unborn baby dies as a result. That's my story and I'm sticking to it.
  • The fact is, an abortion is legal, forcing a woman to have an abortion is not, especially if the death of her baby comes as a result of her death. I would never have an abortion, but it isn't my place to tell anyone they can't have one. Scott Peterson (of Modesto, CA) killed his wife when she was 8 months pregnant, he was convicted of 2 murders, and is on death row. The CA feticide law specifically states: CALIFORNIA CODES PENAL CODE SECTION 187-199 187. (a) Murder is the unlawful killing of a human being, or a fetus, with malice aforethought. (b) This section shall not apply to any person who commits an act which results in the death of a fetus if any of the following apply: (1) The act complied with the Therapeutic Abortion Act, Chapter 11 (commencing with Section 25950) of Division 20 of the Health and Safety Code. (2) The act was committed by a holder of a physician's and surgeon's certificate, as defined in the Business and Professions Code, in a case where, to a medical certainty, the result of childbirth would be death of the mother of the fetus or where her death from childbirth, although not medically certain, would be substantially certain or more likely than not. (3) The act was solicited, aided, abetted, or consented to by the mother of the fetus. (c) Subdivision (b) shall not be construed to prohibit the prosecution of any person under any other provision of law.   • Abortion is a difficult decision that a woman makes regarding when she is ready to have a child. It isn't something that should be legislated as murder - ever - because there are certain circumstances when it can be called for. What if her father raped her and a child was planted in her from that? What if there are serious health problems that could potentially kill the women while having the child? There are so many what if's there, it's not even funny. Now, let's take the other scenario. A man kills a pregnant woman and her fetus. His wife and child. She had decided to keep the baby and for some reason, he decided to take that choice away from her and take her life as well. He should be charged with a double murder. The woman should not.

  • If the woman chooses NOT to have an abortion then she intends to let it develop into a human life and ending that growing process against the will of the woman is something not protected by current law. The woman has a right to say what happens to her body and if that means that she seeks an abortion in compliance with all applicable laws and statutes then it is her right to do so PLAIN AND SIMPLE. If abortion were legally murder then abortion would not be legal. If you believe that abortion IS murder and should be charged as such then you and your like-minded friends can take care of each and every one of those kids who would've been aborted. All of them. Out of your own pockets. And if not getting an abortion causes EVEN ONE mother-to-be to die then you are guilty of murder. You can't have it both ways.
  • So the guy didn't kill his own child, but the woman did. I see an agenda here. While I don't beliive in abortion I also don't believe a woman who has one should be charged with murder if it's legal. The fact of the matter is most laws don't recognize a fetus as human until it is either born or able to sustain life on it's own. And most abortions take place well before that time so there is no crime because there is no victem. Now with the murder there is a diffrent standard. Because the mother wants the child and the death of the child is against her will it is murder. Why? Because her intent for the pegnancy makes it a life. If we did not have this law in place men who murder their wives and children would get off alot easier then they should. A lot of these murders take place when the woman is about to give birth so the baby would be a vaible life. Just remember the number one killer of pregnant women is their partner or the baby's father. We need this law to punish these men for the lowest of all vile acts. If you want my opinion abortion and killing your wife and child are about the same in my book. Either way someone ends up dead. You don't want kids? Don't have sex or use as many forms of birth control at once as you can. Better yet get sterilized and that goes for both men and women.
  • I don't go around killing people, but if I got pregnant and knew that the child would have a hard life because I don't have money, a place to stay, and the time to take care of it, that's a life that I wouldn't want to be brought into, so why would I want to bring my child into it? Die of starvation instead? Commit suicide because of depression because I couldn't give my child the proper amount of time it needs to grow up happy? Please, if that's the kind of life I'd be forced to live, you can kill me too!

  • I think it is a bit of a hippocracy in the social fabric of our world. The life is being snuffed out and intentionally in either case. How to exactly solve it, I cannot say, but something has to be done besides letting it continue just because people won't be responsible for their actions before becoming pregnant, then use the infanticide as birth control.

  • It sounds as though the 8month pregnant woman had certainly decided to have the baby. Therefore as the baby was near full-term then that would be a double murder. Abortion is very different as in that a woman has decided to terminate a pregnancy for whatever reason, or pregancy is medically terminated for a medical reason. My opinion is this is NOT murder, it is termination of a foetus or embryo.
  • I think of it this way: If the law did start couting abortion as murder, then that means the government has offically taken the side of the pro-lifers. If that happens, things'll get pretty iffy real fast. Let's just say this: The woman can choose to abort the baby, thus ending it's potential life, but another person is not allowed to end it for her. Very simple, and it bypasses all that crap.
  • Abortion = physical autonomy. It's not the fact that it is a very small person that makes it less than murder, it's the fact that the mother HAS to kill it to remove it - it can't live without the womb. Whereas you do not need to kill a woman or her pre-born baby to not have them physically leeching off you because they are separate from you in the first place. In the case of a man (or woman!) killing a pregnant woman (and her pre-born kid) or intentionally causing a woman to miscarry: you're not killing them for your own physical autonomy, it's not necessary, and that's what makes it murder.
  • Killing of any and all types is MURDER. A woman who gets an abortion is killing her child. So that is a form of murder.
  • I'm not sure what state your in but I can tell you if your in my state(wv), that man would only be charged with 1 murder. Because that child is not considered a life yet until its took its first breathe. (I know this personally, one of my closest friends was murder while she was 5 months pregant). If abortion is legal in that state that law usually applies even though abortion would be a choice for a woman to terminate something thats going on in her body & life. Murder to a pregant woman would be taking her life as well as the life she wanted to carry & raise & was unjustifibly taken away from her. Not a choice of her own.
  • The man would not be charged with murder for the child if the pregnancy isn't at least 12 weeks in I think. That rule also applies to abortions. I don't think they will be done after that 12 weeks. I could be wrong though.
  • I believe everyone deserves a chance at life. The unborn can't speak for themselves so we need to speak for them. That man got what he deserved. Abortion should be made illegal. It's not fair. It's just like shooting the baby right after they are born. People say that the baby isnt really a living thing until it takes its first breath. Well, they are so wrong. Here's why: On day 17 after conception blood vessels begin to form. Day 18-20 the foundations of the brain, spinal cord and nervous systems are laid. On the 21st day the heart begins to beat. Day 26-27 the lungs are beginning to form. On day 40 the baby makes their first reflexes. They touch around the mouth and that causes them to flex their neck. By 7 months (when abortions are usually performed) the baby will be able to hear the outside world' Also they can smile, hiccup, frown, squint, move individual arms and legs. And they sleep and wake up, they nestle in their favorite sleeping positions. They stretch when they wake. They go to the bathroom. They develop sleeping habits. There are many other things I am leaving out but none the less, we do all these things right? Well then how aren't they alive and real humans? I hope I have been able to change some of your minds, and if i havn't I'm sorry and I hope over time you will learn the truth I know. You were given the chance at life. How could you take what you have from somebody who can't do anything about it and have no say in the matter. They deserve to live just like you do. They can't speak for themselves so we must speak for them.
  • The man should not be charged with murder of the fetus, only murder of the mother. Based on abortion logic, the fetus is not human and some say not even alive and thus cannot be killed and certainly not murdered. Answer edited.
