No. The apartment complex can have the filthiest, nastiest stained carpet in the world and still rent out the space. However, the tenant is only obligated to return the apartment in the same state it was when he or she moved in, so if there's a stain on the carpet a wise tenant will photograph it and make note of it, and have the landlord sign an acknowledgement that the damage exists. This should be done before moving in. This is how the tenant later proves that the damage isn't his or her fault, so that his or her damage deposit isn't wrongly withheld.
