I don't know if they should be charged with a crime, but they should definitely be stopped.

Not for the act of smoking and drinking alone. And who's to say if the fetus dies as a direct result of this that that's a crime. Abortion is legal.

No, even though I agree with the protection af fetuses and children we must remember that the woman has the fetus in her body and she is responsible for how she takes care of herself and the baby. Either smoking/drinking is a crime for everyone or for nobody. If a pregnant woman should be charged for smoking then all the people around a pregnant or a child should too because the innocent child is damaged. Then why limit to fetus or children and not to all? The answer is information about the consequences to pregnant women, they need love, not punishment. Sometimes they've been punished already.

I think so even though I know it's hard for some people to stop smoking and drinking but I guess the way I look at it is if that baby wants to drink or smoke they will and should be able to make that choice for themselves!

I think this has already happened. I seem to remember an old news story about a baby born with health problems, the mother was charged with medical neglect or something. I don't believe she was found guilty.

I don't know if it should be a crime but I think there should be some consequence especially if the baby is born with some type of condition that is related to the smoking and drinking.
