  • Most restraining orders mandate that a person cannot come within a number of feet of the other. They are also only good in the state issued. Unless you live less than 50 feet from the state border, it should work.
  • To be totally safe, you are going to have to have two restraining orders, one from each different jurisdiction. This is to be on the safe side, should a violation occur within one jurisdiction and crosses over to another jurisdiction, especially crossing state lines. Two are definitely needed.

  • The full faith and credit clause of the Constitution ensures that a judgement in one state is effective in another state. However, to have the restraining order enforced in the other state you will normally have to file it with the clerk in the other state. The actual rules will vary from jurisdiction to jurisdiction. After getting a restraining order in your home state you should go talk to the clerk of the court in the other state. The clerk will tell you how to file the restraining order so that it can be enforced.
