You need to get the courts involved. In regards to the unborn child, your brother has almost no rights until the child is born. Your brother does have rights in regards to the 1st child, but he needs a court order to keep the mother (or the kid) in the state. The reason for this is that both your brother and his ex have parental rights, so taking the child is not kidnapping. Tennessee does have a custodial interference kidnapping statute, but this requires a court order of custody. The fact that the ex is illegal is irrelevent to whether she has parental rights, but it could come into play in choosing who should get custody. A court is reluctant to grant custody to a person outside of an American jurisdiction, but it does happen when the other parent is unfit. If the mother is taking the children out of state for the purpose of concealing the child from your brother, then she may be committing a crime. However, proving this intent would be nearly impossible.

If there is no court order for custody then the mother has done nothing wrong, she can take her child and herself anyplace she wants without anyone's permission. The only hope the father would have would be to go to court and ask for an order compelling her to return his child (the one born) back to the child's home state. He's going to need an attorney.
