  • The difference is that trading sex for money creates a harm to society. There are many crimes linked to prostitution, as well as the rapid spread of disease. You may be thinking that the same is true for sex giving away for free (or for dinner and a movie), but not really because the person giving away the sex will usually be picky about who they choose to have sex with. The prostitute, on the other hand, will have sex with anyone who pays. Of course, a more interesting question is: why is it illegal to have sex for money without it being taped, but it is not illegal if the camera is rolling? The simplified answer is that in the latter you are getting paid to "act," and the acting just happens to require sex. But it still seems somewhat contradictory.

It is legal to inherit a fur coat from your Grandma but illegal to buy and sell furs from endangered species. It is legal if your parent allows you to have a glass of wine on a special occasion but illegal for you to buy it if under 21.

  • It's a question of social morality, not of spreading disease. In Nevada, where it is legal to be a sex-worker, they are tested regularly for STD's and require all customers to wear protection. The spread of and contraction of STD's are concerns for both the worker and the legislature. As to why it is illegal in most places? Same reason why you can't ride a motorcycle with out a helmet (in most states) or have to wear a seat beat in a car: you're elected officials decided that this is what's best for you. So, if you want legal prostitution, elect the right people to change the laws.

  • There's a few reason's why making a adult film is legal and prostitution is not. 1- The people preforming are registered proformers. And therefore not standing on a street corner for children or those not interested to see. 2- Part of being registered means they are also legally required to tested for STD's. 3- In the USA the first amendment to our constitution grants all citizens the right to free expression. As the sex act is being recorded it is considered a movie. As a movie is considered art, adult films are protected.
  • Just for starters: Do you think I would bother going to work if I could just root all day instead? If sex was totally morals - free and prostitution totally legal, who would do any real work? I sure as hell wouldn't bother working in mines, dirty old roofs or dusty factories to produce food or power points or houses or cars or whatever else society needs if I could just pump people instead. The only reason there is enough money in prostitution to do it for money is because so many people don't do it. But then who should pay and who should get the money? Why? Every act of prostitution assumes that one person isn't good enough to get laid unless they pay for it. On the other hand, who would bother learning how to seduce a woman if they can just hand over money instead? So now the sex act is degraded to a point where only one person is guaranteed to enjoy it. How handy!
