Bottom line here is, the drugs were destroyed and someone is out a lot of money. If the Border Guards made a mistake, thats okay. at least the drugs are not on the streets. There will always be another day, another time for the drug dealers. They all shoot and kill each other, anyway.

I feel that this event has been an embarrassment for Canada. Then again, it shows just how moronic our justice system is when it comes to protecting the greater good. There was a good editorial in the local paper on the day after the decision (I found it for you and attached it to my answer) that basically shows what the judge wants to happen. Every single decision must be approved by the judge and on and on and on... The border guards were fully justified in doing what they did. Were they wrong? No. They found illegal drugs being smuggled into our country. They did their job and they did it well. How do we thank them? Let the smuggler off with a 'sorry'... You think lineups are bad now? HA! Whats new, they probably cut a deal with the judge or cops. Happens here all the time, people get busted right before the election, they get indited then they get off on some technacality or something. Usually become repeat offenders but they still manage to keep slipping through the cracks.......

It happens a lot here in Canada. Right after we broke up, my ex got caught with large quantities of drugs a lot worse than pot (ecstacy, cocaine, GHB, LSD), and all he got was a fine and a 'warning'. He got the drugs and about 30 thousand dollars in cash taken away, but fought it in court and got the money back. Twisted system we have here.

I don't like the fact that guilty people go free because of an illegal search, but I recognize that we really don't have a better way. If we didn't exclude the evidence than cops would constantly conduct illegal searches. Some have argued that a solution is to hold the cops personally liable. This would work to stop illegal searches, but it would also stop many cops from conducting legal searched out of fear of being fined. Also, many cops conduct illegal searches by mistake, or by a hunch that a person has a weapon.
