do you have a police report? you should follow up with your insurance have an adjust come out to evaluate the damage. they may recommend you get 2-3 estimates for the total cost of damage. If it's not totaled then they should pay for the total cost of repairs as long as the police report backs up your story. . that is your only defense unless it's clear that the damages where is such away that people can see it was the other persons fault. good luck hope you win!

How long have you had the car? It may have been worth 12,000 when you bought it but cars sometimes depreciate & insurance companies will only give you their book value. Did you have any medical bills? I think that was the best thing you couldve done was to get a lawyer because insurance companies will try & give you the minimum that they can get by with. Also don't sign anything until you get a lawyer to double check everything if you did get hurt & you sign something you may eat the medical costs. Good luck

You also need to find out if you have GAP insurance. That is separate insurance from your auto insurance and will cover any 'gap' between what your auto insurance company wants to pay and what is owed.

Many of the comments given are good. I think that getting a lawyer was a smart move! I don't know where you are but many States / Provinces have a person who is responsible for the oversight of the insurance companies (in Canada this person is called the Provincial Superintent of Insurance). Find out what this person is called in your State, contact the adjustor supervisor of the insurance company that your dealing with and tell him that you feel yourself treated in an unfair manner and you will have no other alternate to report this incident to the Superintendent of Insurance (or whatever this person is called in your State. The mention of this will often change the attitude of the insurance company. It's like reporting a lawyer to the Bar Association or a Physician to the Medical Association or you to the IRS; it's a battle no one wants to get into (even if they're right. Good luck.
