It is a private organization and so its rules are created by its members and not enforceable as law except in the same way any contract can be enforced in civil court. Sometimes town ordinances may address the same issue and are enforceable. How to complain about performance of the HOA should be spelled out in the by-laws. Documenting the problem using dates, photos, letters of complaint, will help whatever step you take. If your HOA employs a management company that is failing to perform its duties, you have some leverage since they are paid by the HOA. You may also be able to raise the issue at a meeting of the HOA. If you get an inadequate response, you may be able to elect new officers who will respond. Finally, you might want to consult an attorney for advice on your options.
