  • As far as I know, if the police find illegal substances on you or on your property, and they were on your property with your permission, they can charge you, even if they were there for an entirely different reason, eg: Person A calls the police to report a breakin, the police arrive, you let them in, and they arrest the thief, but while doing so they see marijuana in your house (in open view; they can't go through your drawers and stuff unless they have your permission). In this scenario, I'm pretty sure they're able to charge you with possession, even though they were there to arrest a criminal breaking into your property. If they went onto your property without your permission and without a search warrant or something (or while on your property for a different reason, they searched through your drawers, bags, cupboards, etc without your permission), I don't think they can charge you for anything they find during 'that' search (I'm not sure if that evidence will be usable in court, but they'll just legally search your house afterwards and charge you I think...)

  • If the police were at your home for a legitimate reason, and spot the marijuana in plain view, it can be used against you. I went on a residential burglary one time. we caught one burglar. the back door had been forced open. the owner was not there, but we called him home from his work. in searching the house for other burglars, we discovered scales, plastic bags and a black book opened to reveal different sales of pot to different people and what their balance owed for pot on credit. Also, in plain view was a brown grocery bag, sitting on the kitchen table. it was not fastened at the top and looking inside was about two pounds of marijuana. when the owner arrived home, he was arrested for dealing in marijuana. he was also charged with income tax evasion, since he did not report his marijuana profits to the internal revenue service. Its the little things that get people caught in crimes.
  • You are out of luck, even if the cop has a semi-legitimate reason for being there, anything in plain view is confiscatable. Don't let them in.
