1 drink per hour is the average metabolisation rate of Alcohol. It can be much faster, or Slower, in some individuals. For example, if I have 10 standard drinks in my system at 1am (not uncommon for others, I dont drink) it would take untill 11am that morning for me to metabolise All of the alcohol. If I were to drive a car at say, 8am to get home, Theres a good chance Ill be over the limit. Considering it can take some people longer than an hour to metabolise a drink, and that most people on a big night out dont stop drinking untill early in the morning anyway, its not hard to see how some people can be over the legal limit "the day after"
