It depends on the terms of your lease. If your lease makes no mention of a business or daycare than probably not. Remember, if it's not in writing than it didn't happen.

Not really sure about that, because of where you live. But did you ever consider getting a business license? What city do you live in? What's the square footage of the home? I bet I can find out about the business license. Not saying this will appease the HOA, but maybe your local municipality might be able to supercede. http://www.businessnameusa.com/

Both answers are basically incorrect. If your home is in a community run by an HOA, What you can or cannot do in your home is determined by the Statutes that govern HOA (home owners associations) in your state, PLUS whatever the HOA's governing documents state. If those documents say no home run business allowed, Your landlord can be fined and sued by the Association if he violated rules by allowing you to have the daycare, and you can be sued if in violation of their rules. The local town, city or county does not have the authority to overrule the HOA's governing documents and the State will not either...an HOA is basically a corporation and you live under that coprporate rule.
