  • They shouldn't have to make a law like that, parents should be watching their kids anyway. Whose place do you think it is to watch them? If they get hurt whose going to get the blame? The HOA, they are your kids, your responsiblity. If you don't want to watch & raise them, DON'T HAVE THEM....
  • they have probably been forced, I would bet threatened with law suits. my HOA has a private street and they have alot of rules reagrding kids playing in them
  • It depends on who regulates the streets in the neighborhood. If they are regualted by the city, county or township then the HOA cannot write rules that supercede those laws. Which is why in many neighborhoods residents complain to the HOA regarding cars parked on streets and the HOA cannot do anything about it.
  • Going straight from your answer, I don't think kids should be playing on the street. However, looking at it more realistically, I think perhaps this rule was brought about by the rampamt suing present in the US. I'm willing to bet they simply don't want to be responsible. Having said that, I think that children should be free to play outside, I do think that it is important to have some sort of adult around. My entire childhood consisted of the yard around my house and my neighboor's house, and my mother was indoors but with the windows open she could hear us. However, I don't think she would have allowed us to go much further, the park was a block away and only with a large group of friends and after a certain age could we go alone. Here in my apartment complex, I have seen ( and rescued ) little four years olds running all over the place, and the complex is quite large and not exactly high-class. I would like to see them have more supervision. However, overall, I don't think that this sort of command lays in the jursidiction of your HOA, but rather is something that each parent should be doing if they are concerned about their children. I'd personally see if anyone agreed with me and attend the next meeting and speak up with some well-thought out arguements why this is not really the HOA's business, and perhaps form a group of parents who are willing to provide supervision for their children and for others, like a neighborhood crime watch. Once you have that sort of thing organized I'm sure the HOA will back off. Maybe you can put up signs "slow, children at play" and build a new park or something.
  • I was an elected trustee of a condo association. The common docs (governing rules of the condo) gave us the authority to pass any rule necessary to protect the health and safety of the residents. Children playing in the street fell in that catagory. When I was growing up we played football and baseball in the streets, but we had enough sense to get out of the way when a car came through. Nowadays the children stand in the middle of the street and essentially challenge the drivers. So now we have rules!
  • i live in a hoa and they the kids cant be outside period. we cant use the pool. we have no playground. so what can we do with our kids and yes there is a park down the street. but its crowded after school with baseball and football practice. so what can a parent do from going crazy..
  • It is not a "law," it is a regulation. And yes, they can pass and enforce it. Reasons stated by others are all valid. The streets are for cars, not children.
