Actually, there have been a few cases where people who have had unprotected sex with different partners have knowingly passed on the HIV virus, and have received jail time. I've included some links below and I'm sure there are far more cases out there. The first I found was from 1994. A Kenyan man was given seven years jail for infecting several women with HIV in New Zealand. The prosecution couldn't prove 'wilful infection' so that charge did not stick. In 2003, a Somali man was given 137 years imprisonment for infecting two women in Britain with HIV. He was the first person successfully prosecuted for passing on an STI in Britain in over a century. In Australia in 2006, there were at least two men standing on charges of infecting other men with HIV. One of these men was acquitted on charges of deliberately trying to infect 14 men with HIV. Also in 2006, a woman was jailed in the UK for knowingly infecting her partner with HIV. There are also some other cases where people have been charged for infecting a person with both HIV and hepatitis, but no cases that I can find where a person was charged solely for transmitting hepatitis. I agree, clamping down on this would be a good thing, however if we were to regulate it, we would have to watch that people who suspected that they had a STI still went to a doctor to get themselves checked, rather than got scared off because they were afraid of being charged with something.
