  • If it truly is simple assault and you are the victim of the assault, by not showing up to court you're sending a message that you no longer wish to see the other guy prosecuted. And, the case will be dropped. However, by doing this, you must realize that you will not have a good paper trail to protect you if he assaults you again. (I know that I'd be real tempted to beat your ass for dragging me through the court system, making me pay an attorney, and making me pay bail.)
  • Although I understand your frustration, I would not advise you to just not show up for court. Contact the prosecutor before the hearing to let him/her know that you don't want to pursue the matter. A subpoena is a court order to appear and should not just be ignored.
