The court would have to make a ruling on custody if there was a dispute. The legal system is designed in such a way where the laws regarding parenting and children are suited for the traditional family where the mother and father of the child are married. Any other family situation is judged by the court on a case by case basis. Traditionally the courts have ruled in favor of the mother unless she is incapable of providing a suitable home for the child or if the father can prove otherwise.

First of all, it depends on what state you live in. I am in a similar situation. My child's 'father' was not on the birth certificate and the first (of many) court papers showed me, the mother, as the 'custodial parent' and him as the non-custodial parent. He had signed an admission of paternity.

Posession is 9/10 of the law. There are no court orders at this time. There is no legal decision. However, LEGALLY, as long as the father has proof that he is the father... Each of you have legal joint custody. Posession means that you are currently the legal guardian of the minor, unless or until the court decides to change that through a judgement and court order that follows that judgement.

Unless, the bilogical mother is determined to be physically or psychologically unfit, to raise the child. the unwed biological father, would have no legal recourse. the child would be remanded to a willing family member or awarded into states custody.

No , no , no biological Mother doesn't really have custody of the child ! Both parents are considered . If one goes to court then the judge will decide who gets custody and who pays c/s . Visitation and c/s will be set forth . So if you are wanting to go through the legalities and such , you'd have to go to court . Whom ever takes the other to court to have sole physical custody . Has to prove the other parent unfit . But usually judges gear towards split custody . To give both parents a chance to be in the childs life .

You have custody. Maternity is never at issue unless a man calls it into issue. Your boyfriend has no custody rights unless he goes to court. I do this for a living. It is true. I represent guys like your boyfriend who I begggggggg to go to court, reminding them not to wait until things go bad. Inevitably they don't and if you two ever broke up, Father Dearest would be screwed, screwed, screwed (in most states. I do not know what state you are in and advise you to seek counsel on this situation in your home state. Call the bar association.)
