Texas landowners fighting XL Pipeline, should the State be able to take private land giving it to a private company?

A new coalition held events across the state, Monday, claiming eminent domain powers are being miss-used by the pipeline company; Trans-Canada.

East Texas landowners, who own property along the proposed route, claim they are being bullied by big oil.

“What Texan wants to give up their land to a foreign company anyway or be told the have to I have concerns about their abilities to contain this stuff. I don't want it because I don't want anybody to tell me what I can do with my land,” said Lamar County farm manager Julia Trigg Crawford.

    Eminent domain can't be "misused". It is theft. How can you misuse theft?

    The state shouldn't be able to take private land, or private possessions, to give to anyone.

    They have done it before. I feel its unconstitutional but they do it. Thay did it to build the trans continental corridor from mexico to canada. Other wise known as highway 35 and made alot of it a toll road around Austin for private profit. Now why allow toll roads where you pay a toll when your taxes build roads?

    I'll be honest, I have mixed emotions about this. A few years back the Supreme Court ruled that it was a legitimate use of eminent domain for the government to take land from one private owner and give it to another private owner in order to get more taxes for the land. I remember the liberals all trying to defend that ruling. I remember all of the conservatives howling about the injustice of it. Some even going so far as to suggesting that the Justices' property be taken from from them so that it could be given to someone else.

    Now the shoe is on the other foot. Most of us conservatives want to see the pipeline built. We think that it will have many benefits for the country. However, now we have landowners standing in the way, refusing to sell land along the path. My frustration with them would tend to make me want to say to use eminent domain to take the land. However, in order to be consistent and stick with my previous statement, I would have to say that the company should either make a better offer or find a route around these people's property. So, despite my frustration with these people for standing in the way of a project that I support, I am going to go with my original values and respect their property rights. However, I wonder how many of the liberals who were so fired up in support of the Supreme Court ruling that allows this use of eminent domain will now suddenly become huge supporters of people's property rights as they use this argument to fight against the pipeline.

    Unfortunately, the eminent domain clause can be involved to take away your property. How that's decided should be the point under scrutiny here. But, if it's legal, the Government has to pay you what the land is worth. Doesn't help the owner, but that's what in store for all of us.

    the way I view it if the government wants to declare imminent domain they must offer 125% the highest value in the past 10 years... and if the land values go above that in the following 10 years then they must compensate 125% of the difference as well.
    I understand there are times a few individual retards can cause harm to civil order by just being stubborn and the purpose of government is to create civil order. but any infringement of freedom must be compensated to a greater degree.
