In a community property state (Texas) am I responsible for half of my functioning substance abusing husband's debts even if they are in his name and I got most of the furniture in our temporary agreement?

    All debts created by during the marriage are deemed to be community debts. However, even if the court were to order you to pay 1/2, the creditor cannot sue you for your share unless your name is on the debt (credit card). Sometimes the Court awards one party more than 1/2 of the property along with all of the debt just to make sure that the split is equitable. Texas is not a 50/50 state...contrary to public opinion. It is a "just and right" state...meaning that the court can divide the estate in any manner that it deems equitable.
