I was injured at work but didn't realize it until two weeks later. At that point I let them know, but I was told that because I did not let my employers know right away, I could not file for workman's comp. What are my rights in this matter?

    As soon as you were injured, you should have reported the injury and filled out an accident or incident form, and gone to see a doctor. You may need to hire a lawyer to help you with this one. You would need to be able to prove that your injury occurred on the job and nowhere else. Witnesses would be helpful.

    you have 15 days to report an injury in some cases up to 30 days my knowledge is new mexico your state might be different make them fill out an e1 and an accident report they cant deny you

    Speak to personal injury atty, who will have to argue on your behalf on the basis of new medical reports you'll have to obtain that injury is related to work accident AND that injury is such that the scope of it could not have been reasonably ascertained at the precise time of injury. Time is of the essence here so hurry! Also, the WCB does not properly advise injured workers to seek legal advice at the OUTSET of claim when you've still got a chance. They pretend it's not that important... LIES and TREACHERY! Prepare to do battle. Gosh knows those whose mission it is to protect the fund from depletion will do everything they can to attack your claim. Be a good boy scout: be prepared.
