  • That depends entirely on what the laws are where you live. In most cases, if you are at fault. . .you are at fault regardless of the driver leaving the scene. However, in a lot of places leaving the scene of an accident is against the law. So, not knowing where you live and what the specific laws are. . .I can't really say. I would guess that your insurance company would ultimately have to pay for damages/injuries though since you were at fault and cited. Too many unknowns to answer any better than this, hope it helps :)
  • The answer lies in the intent of each driver. one, for leaving the scene. two, for being at fault. leaving the scene of an accident is a criminal offense. being at fault, in an accident, is not a criminal offense, unless other circumstances are involved, like drunk driving, etc. the other driver left the scene for a reason. you may never hear from him again. your insurance company will repair your vehicle.
