Maryland's inheritance tax applies to any property passed from a deceased person to his or her beneficiaries, with some exceptions. Maryland's estate tax only applies to estates with a passed on valued in excess of $1 million. The state places a dollar amount on the "clear value of property" passed on from a deceased person. It is applied regardless of whether the property was passed by will, law of succession or deed/trust. As of July 2000, the tax is not applied if property is passed to a child, spouse of a child, spouse, parent, grandparent, stepchild or stepparent or sibling. For all other beneficiaries, a tax of 10 percent is applied. According to the Comptroller of Maryland, this tax is applied to the transfer of property from a deceased person, when the value of the property exceeds $1 million. The tax only applies if the deceased was a resident of Maryland at the time of death or was a nonresident but had property that was taxable in Maryland. My mother gave $30,000 to each of her 4 children in 2004. She did not file a Form 709. She passed way Dec 2008 with estate about $15,000 total not including the $120,000 she gave away. Do we still need to file a 2004 Form 709 eve
