  • I don't know what the laws are in the US, but in the UK it's illegal for a child not to wear their seatbelt. Also, children under a certain age (or size) have to be sat in a booster seat.
  • In some places the driver of the vehicle can be ticketed for allowing any passengers to ride without their seatbelts on. There are also laws that apply if someone is injured as a result of an accident where seatbelts were not worn. Here in the US, any children under 4 feet 8 inches and 6 years of age must be restrained in a safety seat (carseat or booster seat) and aren't allowed to ride in the front seat of a vehicle. The charge isn't reckless driving, but probably reckless endangerment or failure to provide for the safety of a child.
