  • Most documents in civil court actions are public records and can be reviewed by going to the court in which the civil court action was filed and asking the clerk for the file. While there can be all types of filings in civil actions, they generally have certain basic documents in common.

    Complaint

    A complaint is the first document filed. It is submitted by the plaintiff's lawyer and sets forth the reasons for a lawsuit.

    Answer

    A separate answer to the plaintiff's complaint is usually filed by each defendant, setting out the reasons why they disagree with the allegations of the complaint.

    Motions, Responses and Replies

    Motions, responses and replies are documents filed by all parties in a lawsuit to persuade a judge that she should or should not do something, such as order the other side to answer questions or turn over evidence, or even order dismissal of a case. These documents contain the parties' interpretation of facts and legal arguments.

    Depositions

    Depositions are interviews of parties and witnesses conducted under oath by lawyers and transcribed by a court reporter. Depositions may or may not be filed with the court. If they are, they generally are viewed as public records.

    Judgments

    A judgment is the document that states the outcome of a case.

    Filed Under Seal

    In some instances, lawyers may file a motion to have a document filed "under seal." If the judge grants the motion, the document will be sealed and unavailable for public viewing.
