California does not require private employees call in sick, and leaves the policy to the employer. Government employees have to gain approval for leave.
Typical Sick Days
Private employees agree with the employer on the policy for taking a sick day for a typical illness, injury or doctor's visit. Without any state legal requirements, the employer can require the employee call in each day he is absent.
California Medical Leave
A private employee with a serious health condition that prevents work can take days from the 12 weeks California's Fair Employment and Housing Act requires employers make available to employees. The employee has to give reasonable advance notice to the employer on when the leave will begin and for how long the leave will last.
Medical Leave Certification
The employee proves the need for medical leave with certification by a licensed health practitioner.
Government Employees
California government employees can call in sick for health conditions that make the employee unable to work.
Approval
The employer's superior or manager has to approve sick leave an employee takes. When leave abuse is suspected, the superior may ask for a doctor's certification.
