  • Most states require drivers to have car insurance in order to be able to take to the streets, but many people can't afford the costs, or simply choose not to get insurance. If these people become involved in a car accident, however, the consequences can be disastrous, especially if they are at fault. If you do get into a car accident and you are without car insurance, there are several steps you should take to ensure you minimize your damage.

    At the Accident Scene

    If an accident occurs, no matter what else happens, talk to the police. Granted, driving without insurance could cost you your license, but having the police there will help determine which driver is at fault. Without the police, it could turn into a he said/she said argument if you ever go to court. Also, if there is no accident report, it might be easier for the other driver to pin the accident on you. The police will take a report which will be used by the other person's insurance and your lawyer to determine fault. If you are not at fault, the other person's insurance should be able to pay for any damage you or your car has faced. Also, once an accident has happened, get the name of any and all eyewitnesses who can determine what may have happened. Finally, take pictures of the accident scene as these will ultimately be used for evidence. Make sure you get pictures of the road conditions, the damage to the other car, the damage to your car, and any other information you feel is pertinent.

    After the Accident

    After the accident is over, it is important to call a lawyer and set up an appointment. Unless it is blatantly the other driver's fault, there is a good chance you will be sued for damages pertaining to the accident. This is where the accident report and any evidence from the crash site will come to use. If the accident isn't your fault, your lawyer will try to prove that the other driver's insurance should pay for everything pertaining to the accident. This is vitally important. If you have no insurance and any part of the accident is deemed your fault, you will open yourself up to litigation and will have to pay all judgments against you out of pocket. This can be extremely costly if multiple damages to the other party are awarded.
