The federal rules of criminal procedure in federal court have set guidelines for sentencing defendants. They take into account the criminal history and the level of the offense. Sentences are set to deter future crime and to protect the public. The military crime would be a federal crime and the penalties are more severe at that level. I've seen bank embezzlers who have embezzled over $200,000.00 receive a sentence of 12 months imprisonment or probation and I have seen a young man, age 19, sentenced to 10 years imprisonment for cultivating marijuana. To answer your question, no, I don't think a murderer should receive a lighter sentence than that of a hacker and I have no doubt that it could happen.

if the information he was compromising could have murdered many people, I can understand why the sentence is severe. People have to realise that hacking into government computers is not a game...they are "playing" with human lives.
