Until after the court settlement, the car belongs to the registered owner. If he is the registered owner, he can give the car to his sister.
If your name is also on the registration, the ownership of the car will be decided during the property settlement stage of the divorce.
If you are registered as the sole owner of the car, he has no say about what you do with it.
just curious... how long untill he comes back?

You're reading I was just served divorce papers by my husband who is serving overseas. He informed me that he wanted my car that we are still paying on and that while he is gone I have to turn the car over to his sister. Does he have the right to do this legally?

He is not due back until May 2010. We are both the register owners of the car.

Ask his commanding officer to provide you with a lawyer. His return date is not really relevant for the divorce settlement. The property can be divided by the court even before the final divorce. Your lawyer will take care of it for you.
Since you say your name is also on the legal registration for the car, you do not have to give it to his sister.
