I don't know, but that would be a very pointless and childish thing to do.

ok, what adult thing should I do to my neighbor instead?
Avatar Vaporeongirl Nov, 03 2009 at 09:58 PM
Ignore the tree branch and concentrate on more important things.

I already did that so now I have leisure time. A man fell off a roof and landed on my car but my neighbor keeps telling people something else happened. Otherwise I might overlook the nuisance tree.

What logical reason could you use for doing such a thing?
Is the root damaging anything on your property?
Or, do you have some grude against him?
Trees provide too many benefits to be so thoughtlessly destroyed.
You need to get a life.

"Trees provide too many benefits to be so thoughtlessly destroyed." <== I can't name any meaningful ones.
Avatar Anonymous Nov, 04 2009 at 05:15 PM
If you can't, then you're just not trying.
Provide shade, provide shelter for animals and birds; provide inspiration to the creative ("I think that I shall never see a poem as lovely as a tree ....." (Joyce Kilmer); help purify our atmosphere; provide building materials; provide materiel for mulch; provide ..... well, even you should be capable of getting the idea.
Do your neighbor ..... and yourself ..... a favor and back off. You're not proving apoint; you are proving your silliness.

Not trying? Let's actually examine how silly the benefits are that you report.
a) "provide inspiration to the creative ("I think that I shall never see a poem as lovely as a tree ....." (Joyce Kilmer);" <== Tree-based though process is based on the placebo effect at best. I have never needed a tree for inspiration and I do not believe it could provide me any.
b) "provide shelter for animals and birds" <== I do not need or want pet tree rats. As a taxpayer I have an extensive collection of birds and animals. The zookeepers look after them and any time I want I can go visit them for free.
c) "help purify our atmosphere;" <== all the CO2 a tree absorbs is given back off when it rots
d) "provide building materials; " <== these come from forests managed for timber production ... not from a spurrous tree in someone's front yard
...
and so on and so forth

I think you can do what you want with your own property. In the name of being a good neighbor, though, I would advise you not to do anything like that.

Besides, the tree is good for shade on both your properties.

I'm not worried about the shade. I think the tree is a nuisance.

I would talk to your neighbor first but I would say you have a right to do what you want on your own property specially if it's killing your grass or an eye sore. just try and be civil with him and not strike up a fight, he had know idea where the routs would grow

If you and your neighbor can't agree on a solution, it becomes a legal issue. Check this link:

BEST ANSWER <== why? it actually answers the question (although you have to actually follow the link and read, ugh). Turns out it is illegal to poison the tree even if it is on your property but you can sue your neighbor for any nuisance.
