  • Speaking for myself, I would not agree to a plea bargain if I was innocent.

  • Good question. I would say probably not usually, but I'm sure that it has and does happen.
  • The percentage is very low. Only a homeless person or a person with a psychological disorder, would do this. I never arrested a person that was not guilty.
  • Of course. It all comes down the cost benefit analysis. Sometimes it makes more sense to plead guilty, even if you are innocent, to avoid the risk and expense of trial.

  • SOmetimes the D.A, will offer a very short sentence to a person that they believe maybe innocent just to gain the conviction. If the person could not bail out, instead of going back and forth to court and staying in jail for God knows how long, they may opt to take the deal and get the hell out of there. They can get it expunged later to remove it off their record.
  • Definitely. The problem with "truth" is that it can easily be manipulated. So even though an innocent person may be merely accused of a crime, if someone (a lawyer) can make the jury believe the "truth" that they are spewing (which is obviously not true) then why shouldn't the innocent person agree to a bargain? If a lawyer has evidence that could lead people to think I'm guilty, then instead of being innocent until proven guilty it's now guilty until proven innocent. When an innocent person gets into that kind of situation, self survival kicks in and they'll just do anything they can to limit the amount of punishment they will face because of the inherent flaws in society. It's just the way it is.
