I guess whoever finds it first. In this day and age, I would find it hard to believe that there are any undiscovered uninhabited places left. Many places that are new to the western world have been known to local indigenous cultures for many years, and even if they do not inhabit the land, I think if they know about it before you do, then you cannot claim ownership.

These days, if no one was living there, and there was no title on it from surrounding countries, I guess the discoverer could make a claim. However, it would be disputed by all and sundry...I wouldn't like his chances of keeping it.
