  • If you have to pay the balance of a down payment on closing day, don't pay. You need to speak to a lawyer or in the least your real estate agent to see what action you can take. If the house is yours then I suppose you can change the locks. Your chances are better if part of your original offer included "vacant" premises. Good luck.
  • You can charge them reasonable rent or evict them.
  • Read your contract. If the clause was put in that stipulated they be out by a certain date, then there's your answer. If it didn't, charge them rent until they get out. In the state of Georgia, if it is not written into the contract, they have 7 days to vacate after the closing date, or they can be physically removed by the police/sheriff. I can't go on to the next question without asking this, though. What's the harm, if they stay a short while after the closing date? You said you WANT them out, but that isn't the same as NEEDING them out. I had the same situation on the last house I closed. The owners of the house I bought had nowhere to go, because their new house wasn't finished being built. I let them stay an additional 30 days, but I also made sure that was written into the contract. +5
