Question

Help answer this question below.

My two brothers and my sister put a time capsule in our yard when we lived in NY. I know exactly where it is. Some one lives there now, but am I allowed to dig it up? It is ours, just in their yard. =) Or would that make it theirs now?

Technically it is on their property. Why don't you just ask politely if they would let you dig it up? They might be interested to see what's in there too!

If you want to dig it up, I would suggest asking them for it. If you just show up and start digging they are liable to just shoot you and ask questions later.

- Yeah I don't think I'd just go and dig it up but I'm wondering if they tell me no, do I have any rights to it. not something I want to go to court for to get back.. then agian I don't remember what we put in it so maybe I would.

The time capsule is your property, though legally it would probably be considered abandoned property. The land is definitley not yours.

However, if you explain the situation, I imagine the current tenants would be happy to let to retrieve your time capsule. Good luck.

Sorry, it is theirs. But you could probably contact them and ask to dig it up. I think most people would give you permission so long as you were careful with their yard.

- Correct - when you buy the land, you buy what is under it as well. I would not only ask politely and not tell them where it is, but don't tell them if there is anything valueable in it either.

- Yes...I do right now actually. The people we bought this house from had a lot of heirloom plants, things from her mothers garden, etc. I let her come back whenever she wants and take clippings and dig up plants that are ready to be divided.

Yes,
its rightfully yours and your stuff in it. go to the persons house and go to the door and say that i used to live here when i was younger. then explain the time capsule in the backyard and say it still there. just don't be pushy.
