Technically you aren't supposed to. And if your state has a law against it, you can't use ANY kind of headphones while driving. But if there is no law against it in your state than you can use any kind of headphones, as long as you can still hear sirens of Police and such, and other things that are going on around you. (i.e. Keeping on headphone out of your ear.)
