I was injuried at work. It was reported over a month and few days ago. I still dont have an answer if this is approved or not. How long does the insurance company have to approve or decline this claim? I am tired of waiting.

    being a worker's comp. adjuster/paralegal, they have 24 hours to give you a claim form upon knowledge of your injury. once this jurisdictional claim form is filed, it evokes the statute of limitations. they then have 14 days to either accept/deny or file for additional time which is a delay. a delay is only an additional 14 days. they actually can drag their feet for up to 28 days a lot of times, these adjusters are overworked, large case loads and don't know what the hell they're doing, so things fall by the wayside. this is what i recommend for you- which always seems to work. you need to get on the phone on a daily basis and bug the hell out of them. also threaten to take it to their manager. the manager is under the threshold and duress of making sure their claims adjusters uphold the law and within the appropriate time restraints. there are serious implications and penalties for their failure to do so. if you did not get a letter that was posted by us mail within 14 days as to what they are doing- this issue is up for penalty situation. 10% on wages is you are losing time and they continue to accumulate by a larger degree. the penalties are even applicable and payable to you on late medical bills that they have so bravely refused to pay. employer's get in trouble all the time due to their lack of ethics. they just don't seem to learn their lesson. however, they are licensed and could risk their very throats if they don't handle things within the scope of the law. if your injury is serious, call an attorney in wc right away. they take no money up front. they only collect upon conclusion of your claim. i recommend bradford and bradford in fontana, ca if that is where you are living. if not write back and i can get you to the right parties in various other states.

    It could take a long time...months. So many people are getting hurt at work now. It's taking a friend of mine about 13 months and he has an attorney working on his case.
