I disagree with your analysis of why a drug should possibly be legal or illegal. I furthermore find your analysis potentially dangerous to smoker's and drinker's rights. The reason to legalize drugs has to do with increased personal freedom and liberty … it has to do with who owns your body --- yourself or the government. It has nothing to do with health.

Your question demonstrates a general ignorance of American criminal law. There is not a single act in America that has been deemed a crime because the act harms the individual. Rather, we only make acts a crime when the act harms society. … And FYI: MDMA is far more dangerous to the indiduval than alcohol or cigarettes. There are only a handful of deaths per year because only a handful of people use MDMA. That would certainly change if it were legal.
