What are the potential liabilities for an employer who lists a job classification as exempt, has three full-time employees in this job classification, and pays two of the employees on an hourly basis and one employee as exempt?

    I suspect you meant to ask something different, but the answer to the question you asked is none. An exempt employee is merely someone who CAN be paid a salary without having to pay the person OT. The employer can certainly choose to pay the person hurly if they choose.

    Employers only get in trouble when they classify an employee as “exempt” when they don’t qualify for the exemption.
