It is most unfortunate that the word discrimination received some racial overtones. Actually all people should be discriminating. They should know how to sift good from the bad and follow the good. That is the essence of discrimination. It is imperative that all people, regardless their racial status, should be discriminating and choose good and avoid all things bad.

Separate restrooms for men and women. Our judicial system, when investigating discrimination in violation of the Equal Protection clause, has different levels of scrutiny for the various classes of potential victims. Discrimination based on sex are subject to 'middle-tier' scrutiny' (serves an important state interest) such as the case with different restrooms for the two sexes. Discrimination based on race or religion, however, is subject to 'strict scrutiny', which is why there can not be separate restrooms for blacks or jews.

On what basis? Race? Gender? Sexual orientation? Species? It is, for example, discrimination to refuse to hire a parrot to drive a school bus. But it's not unlawful discrimination -- in fact NOT discriminating in that way would be criminal. (Although it could have comic aspects as long as nobody got hurt.) I wish people would understand that just because something is discrimination doesn't make it illegal. For example, in most places in the United States it's perfectly legal to fire somebody from a job simply because that person is gay. Now, maybe that kind of discrimination ought to be illegal, but for the most part, it's not.
