if the ball doesnt make contact with the bat or the bat doesnt cross home plate its a hit by pitch.

It's a dead ball, HBP in both situations. If the batter is pulling away, trying to avoid getting hit, it is a hit batter and he is awarded first. If he is offering at the pitch, or the pitch is in the strike zone, it's a strike and his at bat continues unless it was the third strike, and then he is out. It is never a foul ball.
