I live in Florida and my mortgage holder filed a foreclosure action. I filed a motion to dismiss, should I request a hearing date or wait for them to do it?

I would imagine that the court will set a hearing date . Don't know why you filed a motion to dismiss ... IF you are NOT making your mortgage payments; you just CAN'T live in the house for FREEE .... Have you TRIED re-financing or a loan modification ?

Start looking for a new home now. Waiting to the last minute will result in your settling for inferior lodgings. The foreclosure is a done deal, pack your bags and get a head start on the rest of your life.

If they are the plaintiff(s), they pretty much call the shots. You just follow their lead. Also, make sure that you request that they provide all the mortgage documents, particularly, the note. I hear that in the heist of things, many of them didn't have the paperwork in order and you may be able to get away scotts free if they don't
