  • Depending on the state you live in and the circumstances for filling divorce you may be able to do a default, but you will need to consult an attorney on the specifics of how to do so. When I filed for divorce my ex refused to fight, sign, or do anything but drugs so my attorney filed for default. Which to my knowleged is a paper sent to the ex saying you if you won't sign and won't fight you arn't interested and the divorce will be decided by the Judge. Then the judge gives a waiting period for response and then the divorce pushes on. If the husband is just refusing to sign and wants to try to fix things you will probably have to jump through all the hoops untill there is no hope of fixing the marriage. Then the divorce will eventually be final. My brother in law's divorce took four years.
