How can I prove my ex-wife is living with her boyfriend. He's an illegal alien and neither of them is on the lease.

It matters because I am paying her a TON of alimony and the kids live with me. This money should be in our kids hands but I have to pay her. In California, if you live with someone of the opposite sex, then the court MAY say I don't have to pay alimony. That is why I want to know.

Thanks for your answer, I have thought about the PI thing, but I'm not sure what the court needs for proof. Could pictures or video of her and him going into the house together every night for a week be enough? I don't know. I don't really want to call immigration because from what I've seen, he's a nice guy. Thanks!

Wow! That was a wonderful answer. I'm actually asking because I pay her almost $1000 in alimony every month. I have legal and physical custody of our 2 children and the alimony is killing me. According to CA state law, if she is living with someone of the opposite sex and getting support from him, the alimony could be reduced or eliminated all together. I just don't know how to prove it to the court that she is living with him. It is not a custody battle at all, but if she were engaged in criminal activity, that would definitely make me want to have the visitation adjusted. I think you need a "Jump To Conclusions" mat.

Why should I have to pay her? No, a tax deduction is not enough. So getting about $280 back from my $1000 a month is supposed to make me thrilled to pay her? I work over 40 hours a week, take care of my (and her) kids and am paying ALL the bills that we accumulated during our marriage! Is it so horrible of me to not want to pay her alimony?

You're an idiot. Did you ever stop to think why I would be asking how to PROVE that she lives with her ex? I don't give a crap who she lives with, but CA law does. I give her %25 of my income so that she can sit home and live off some guy? Maybe I will report him, because her getting married is the best possible outcome for me. Then alimony will definitely be over with.

I am not the least bit jealous...if anything, I just feel bad for the new guy...

Don't take that out on me. I got screwed too. My ex found someone on the internet and left me and our two boys to go live with him...now I'm paying alimony...sounds fair to me.

I understand why: My husbands ex by thier divorce decree cannot live with anyone or she stops receiving alimony: Its tough to prove, We get closer to the answer everyday but it is complicated it's not just one thing. And ignore the rest of the boneheads who think you just have not moved on- Sometimes there is no moving on its a miserable existance when you stuck to your ex becuase of Alimony
