To be honest, hes 43 and is wayyy past custody battles. Or do you mean, does he get assistance from the government and how would you go about getting it?

If he is of sound mind but needs help - then I would think you do not not need to get custody - what you need to do is help him out and let him live with you. Both of you can decide what rent to will be etc. If he is not of sound mind then someone/state has to step in to protect him. I hope this helps.

This is a question to be dealt with the family & yourself. His mother was probably his "guardian" and without proper care would end up in an institution. You might try to find out who his casemanager is to discuss the options. Every disabled person has a case manager through the state in which they live. It might be listed under something like "Senior And Disabled" with the Department of Human Services. Yet since you aren't a relative you will need permission from a family member to talk with them because of privacy laws. I hope you know what you're getting into.
