Only if they have Diplomatic Immunity. Foreign nationals in The United States of America are subject to the laws of this country.

Nope they can pretty much do anything include to up to deportation of country of origin and report the crime if they got busted for one to their home country. Constitution is for citizens of the US you still have to obey laws of both country's while you are a visitor of a foriegn country.

That depends on where you are being searched. For example, you have no 4th Amendment protection against border searches. This is why the border patrol can search every car that comes in (if they chose) without probable cause or a warrant.
