Our legal system does not enforce illegal contracts. It's the same as if someone sells you marijuana and it turns out to be oregano. The courts will not enforce an illegal contract.

if this person had came here legally (like thousands before them)they would have legal rights and could take legal actions.if they did not chose to come here legally they dont have any more legal rights than any other common criminal trying to buck the system.
